{"id":960,"date":"2017-02-11T21:40:25","date_gmt":"2017-02-12T02:40:25","guid":{"rendered":"https:\/\/www.activepw.org\/?p=960"},"modified":"2017-02-16T00:06:02","modified_gmt":"2017-02-16T05:06:02","slug":"action-alert-support-two-pro-bike-bills-in-the-virginia-house-of-delegates","status":"publish","type":"post","link":"https:\/\/www.activepw.org\/?p=960","title":{"rendered":"Action Alert: Support Pro-Bike Bills in the Virginia House of Delegates"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-961 aligncenter\" src=\"https:\/\/www.activepw.org\/wp-content\/uploads\/vageneralassembly-building-300x176.jpg\" alt=\"\" width=\"487\" height=\"286\" srcset=\"https:\/\/www.activepw.org\/wp-content\/uploads\/vageneralassembly-building-300x176.jpg 300w, https:\/\/www.activepw.org\/wp-content\/uploads\/vageneralassembly-building-676x396.jpg 676w, https:\/\/www.activepw.org\/wp-content\/uploads\/vageneralassembly-building.jpg 692w\" sizes=\"auto, (max-width: 487px) 100vw, 487px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #ff0000;\"><strong>Up<\/strong><strong>date<\/strong><strong>:<\/strong>\u00a0 On February 15, the Criminal Laws Subcommittee of the House Court of Justice Committee tabled (killed) SB 1339 on an unrecorded party-line vote, while on February 13 Subcommittee #1 of the House Transportation Committee killed SB 1338 on a 3-4 vote.\u00a0 Thus, both bills are now dead for 2017.\u00a0 Delegate Rich Anderson (R, HD-51) helped kill SB 1338, while Delegate Jackson Miller (R, HD-50) helped kill SB 1339.\u00a0 <strong>Ask Delegates Anderson and Miller to support future legislation to better protect pedestrians and bicyclists from irresponsible motorists.<\/strong><\/span><\/p>\n<p>Two bicycling-friendly bills, filed for the 2017 Virginia General Assembly by <a href=\"http:\/\/apps.senate.virginia.gov\/Senator\/memberpage.php?id=S100\">Senator Scott Surovell<\/a> (D, Senate District 36, which includes part of Prince William County), were approved by the Virginia Senate and are now before the Virginia House of Delegates.<\/p>\n<p><a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?171+sum+SB1338\">SB 1338<\/a> would establish a traffic infraction when a motorist drives in a bicycle lane to pass or attempt to pass another vehicle.\u00a0 (This bill also generally prohibits travel in a bicycle lane via motor vehicle or moped for the first time.)\u00a0 The Virginia Senate passed SB 1338 on a 23-17 vote, with only four Republicans voting in favor.<\/p>\n<p><a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?ses=171&amp;typ=bil&amp;val=sb1339\">SB 1339<\/a> would establish a traffic infraction when a careless or distracted motorist is the proximate cause of serious physical injury to a pedestrian, bicyclist, or other \u201cvulnerable road user\u201d, as defined in this bill.\u00a0\u00a0 The Virginia Senate passed SB 1339 on a 21-19 vote, with only two Republicans voting in favor.<\/p>\n<p>On February 13, both SB 1338 and SB 1339 were heard by the seven-member <a href=\"http:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?171+sub+H19001\" target=\"_blank\">Subcommittee #1 of the House Transportation Committee<\/a>. \u00a0 <strong><a href=\"http:\/\/virginiageneralassembly.gov\/house\/members\/members.php?id=H0210\">Delegate Rich Anderson<\/a>, <\/strong>a Republican who represents House District 51 through a wide swath of Prince William County, <strong>is the only local member of this subcommittee.<\/strong><\/p>\n<p>As recorded <a href=\"http:\/\/virginiageneralassembly.gov\/house\/reports\/reportsItem.php?id=1676&amp;ses=171#\" target=\"_blank\">here<\/a>, Subcommittee #1 failed to report SB 1338 to the full House Transportation Committee on a <a href=\"https:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?171+vot+H1901V0034+SB1338\" target=\"_blank\">3-4 vote<\/a>.\u00a0 Thus, unless someone (such as Del. Anderson) who voted against reporting SB 1338 changes his mind and asks that SB 1338 be reconsidered in the full Transportation Committee, SB 1338 is now dead.\u00a0 If SB 1338 is miraculously resurrected I will update this post.<\/p>\n<p><strong>Subcommittee #1 recommended that SB 1339 be referred to the <a href=\"http:\/\/lis.virginia.gov\/cgi-bin\/legp604.exe?171+com+H8\">House Courts of Justice Committee<\/a>, so SB 1339 is still alive.\u00a0 The Courts of Justice Committee meets on Monday, Wednesday, and Friday afternoons, so SB 1339 may go before that committee in a few days.<\/strong><\/p>\n<p><strong>Delegate Jackson Miller (R, HD-50) is the only member of the<\/strong> <strong>House Courts of Justice Committee from Prince William County.\u00a0 Please call or email Delegate Miller as soon as possible to ask him to support SB 1339.<\/strong><br \/>\n<strong><br \/>\n<\/strong> <strong>Del.
